Terms of Use – DropTale

1. Introduction

This page (together with the documents referred to on it) outlines the terms of use ("Terms of Use") under which you may use the DropTale mobile application (the "App"). Please read these Terms of Use carefully before downloading, installing, or using the App.

By downloading, installing, or using the App, you accept these Terms of Use and agree to abide by them. If you do not agree with these Terms of Use, you must stop using the App immediately.

2. Operator Information

The App is operated by DropTale AB, a company registered in Sweden with an office at Ringvägen 114, 116 61 Stockholm, referred to in these Terms as "we," "us," or "our."

3. Changes to the Terms

We reserve the right to change these Terms of Use at any time without prior notice by posting updates at www.droptale.app or updating the App with new terms. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms of Use.

4. Eligibility

To download, install, or use the App, you must be at least 18 years old. If you are under 18, you must obtain consent from a parent or guardian before using the App.

5. International Use

The App is operated from Sweden. If you access or use the App outside the European Union, you do so at your own initiative and are responsible for compliance with local laws and regulations. Downloads or usage outside the EU may be subject to government export controls or restrictions.

6. Your Responsibility for Access

You are responsible for securing your own mobile device, internet connection, and any applicable network costs required to use the App.

7. Prohibited Use

You agree not to use the App in any way that:

  • Violates any applicable law or regulation
  • Is fraudulent, unlawful, or misleading
  • Is offensive, defamatory, obscene, or discriminatory
  • Infringes intellectual property rights
  • Harms or disrupts the App, its users, or our operations

8. Restrictions on Copying and Access

You may not copy, reproduce, resell, or exploit the App or its content without our permission. You must not attempt to access, interfere with, or disrupt the App or related systems without authorization.

9. User Content License

When you upload photos or other content to DropTale, you grant us a non-exclusive, royalty-free, worldwide license to store, process, and transmit your content solely for the purpose of operating and improving the App. You retain full ownership of your photos. We do not access, view, or share your personal photos except as required to provide the service or comply with the law.

10. QR Code & Link Sharing

When you create a gallery and share it via a link or QR code, that gallery becomes accessible to anyone with the link or QR code. You are responsible for deciding with whom you share this information. You can disable or delete shared galleries at any time through the App.

11. Disclaimers on Content

All content in the App is provided for general information and sharing purposes only. We are not liable for any reliance placed on such content.

12. Availability, Security & Accuracy

  • We do not guarantee that the App will be available without interruption or error.
  • We may suspend or restrict access at any time without notice.
  • The App may not be compatible with all devices or software.
  • We may update or modify the App at any time.
  • We do not guarantee that all information within the App is accurate, complete, or up to date.

13. Independence from Platforms

The App is independent of any platform (e.g., Apple, Google) and is not endorsed by them. Your use of the App is also subject to the terms and conditions of the platform provider. The platform provider and its subsidiaries are third-party beneficiaries of these Terms of Use and may enforce them.

14. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF THE APP. If we are found liable, our total liability will not exceed $190 USD.

15. Your Representations and Warranties

You represent that you will use the App in compliance with these Terms and all applicable laws.

16. Indemnification

You agree to indemnify and hold DropTale AB harmless from claims arising from your use of the App or violation of these Terms.

17. Intellectual Property

The DropTale name, logo, and related trademarks are owned by DropTale AB. All content in the App is our property or used under license. You may download or print content for personal use only and must not redistribute it for commercial purposes without our permission.

18. Privacy

Our collection and use of personal data is governed by our Privacy Policy.

19. Third-Party Links

We are not responsible for third-party websites linked in the App. You must not copy or frame any part of the App onto another website or mobile application.

20. Miscellaneous

If any part of these Terms is found unenforceable, the remaining terms will remain in effect. You may not transfer your rights under these Terms. These Terms represent the entire agreement between you and DropTale AB regarding the App. Any disputes will be governed by Swedish law and subject to the exclusive jurisdiction of Swedish courts.
